Mueller, a 1968 Vietnam Veteran. The mutually agreed statements can be heard at the very end of the last taped phone call. It shows the knowledge of being taped was known after the fact. I call this citizens homeland security wire-tapping.&lt;br /&gt;&lt;br /&gt;This is my written transcript of the tape. The quality of the tape was rather poor because of the noise of my computer and low-end recording device.&lt;br /&gt;(Transcript has some personal remarks in bold parentheses)&lt;br /&gt;&lt;br /&gt;According to my phone bill:&lt;br /&gt;First recorded conversation was at 2:08 p.m., on Jan. 23, 2006.&lt;br /&gt;Second recorded conversation was at 10:36 a.m., on Jan 25, 2006.&lt;br /&gt;&lt;br /&gt;I spare the listener painful high-pitched feedback sounds at the beginning of the first recorded phone conversation.&lt;br /&gt;&lt;br /&gt;1st Conversation with Mr. Gil Merrill&lt;br /&gt;Gil:&lt;br /&gt;I’m fine but I don’t know what you’re geten their at the other end.&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Oh, I’m ok here now. I’m going to try and type at the same time. Spelling of your first name?&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Gil, G i l&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Ok, last name?&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Merrill, M e r r i l l&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Have you had any results as to regards to what’s happening?&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Iii, no decision yet. We’ll be getting back to you pretty quick.&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Ok, is their any questions you want to ask me now that you got me here?&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Not, not right at the moment.&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Can I ask you any questions?&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Sure I’m on the phone.&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Ok, (Fumbling for my paper work stalling for time I then say)&lt;br /&gt;I got some questions in regards to the letter I sent you, in regards to the Senior Community Services Employment Program. (My fumbling and stalling continues) Aaa, see if I got it here. The pamphlet part? Where it says your personal guide to The Senior Community Services Employment Program.&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Yaaa&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;When you open it up to the first page there. To page two, where it says, “The primary objective of this program is to foster and promote useful part-time opportunities in community service activities for unemployed low-income persons who are 55 years or older and that.” By any chance do you have that in front of you?&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;No I don’t, but I kind of know what you’re talking about.&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Ok, I made some comments about it about cronyism and Joyce getting all those extra, that extra time.&lt;br /&gt;Gil:&lt;br /&gt;Yaaa&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Did you talk to anyone regarding that? I mean is that a violation?&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Right now what I’m looking at is what it relates to you not so much the allegations as it relates to other folks. So I’m not at liberty to talk about those, but I, I trying to figure out what happened to you and what your rights are, make sure that what that we deal with that, as it relates to the other things we will have to take a look at those. At the same time you know, your, your complaint, for lack of better terms, Aa, I’m calling it a complaint. Aaa, is aaa are we going to as it relates to you, anything that we think is there that quads us looking at we’ll take a look at.&lt;br /&gt;&lt;br /&gt;(Now it seems to me that Gil is separating my complaint into two different complaints)&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Ok, I’m on page number 3 then, where it says Tour Of Duty. Where it says that where a, the program is designed to meet both your needs. Theirs and mine.&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;All right.&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;And I can work more hours or fewer hours. And I underlined or. But it seemed to me that the problem with me is they wanted me to work more but they weren’t willing to work more but, weren’t willing to have me work less, even though I was unable to work more. The program was pretty much setup to deal within the confines or the ability of the person doing the job. So have you looked into that?&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Ya, so it’s clear that what their talking about is that a, the two parties coming into agreement as to what, what is to be possible with in the broader parameters of the program.&lt;br /&gt;&lt;br /&gt;So aa, it’s rather evident that a signed agreement between you and, you and the Forest that exactly how many they number of hours. They have a need and you have a need and you guys where having trouble getting, agreeing on a, how to meet those needs. So obvious their was an area of disagreement their.&lt;br /&gt;&lt;br /&gt;(It appears to me that the Forest Service was NOT abiding to the rules and “laws” stated on page 2, paragraph 3, of the SCSEP Personal Guide. In defense of Gil he doesn’t have the Personal guide in front of him as I did.)&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Right, and that’s what I’m saying, they weren’t as fixable as they tried to make out to be. I’m saying they weren’t willing to work with me as designed in the program when they hire someone from the community senior employment program and this person and trouble holding a job or finding a job because that’s one of the qualification you have to be to even get into the community employment program.&lt;br /&gt;&lt;br /&gt;(I’m trying to stay with the same subject and that being, the Forest Departments SCSEP program was designed to deal within a person’s abilities and then train them.)&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Well the main idea of course is try and aa find the need that they have and the need you have and that seems to me the problem of the of a being the two of you being able to accommodate each other so.&lt;br /&gt;&lt;br /&gt;(If Gil keeps saying the problem is agreeing then I say the same thing, stay within the rules and there will be no disagreement. Gil doesn’t seem to care if the rules are being broken?&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Ya that’s what I’m saying, that their, their not being honest in regards to the their flexibility, they being able to work towards my needs. And the fact they had me working, did you see the schedule there? Where they got me working 40 hours in the last day of December? (I intended to say last week of Dec, see Schedule in 15-page package) That’s getting ridiculous for someone coming into this program on a part time and learning basses.&lt;br /&gt;&lt;br /&gt;And the other fact that I wanted to bring up, that they had no training program. I can’t even get in touch with the person who was in charge of the training program. Aa that, Crystal Johnson, have you talked to her at all?&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Yaa, she a, she’s out of the office this week on and a train, a meeting type so I haven’t talked to her this week (Gil’s fumbling for words seems uncertain for some reason?)&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Have you had a chance to talk to Mary Trelord?&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Aa, not yet but&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Have you asked them about the type of training they give me? They didn’t give me any. So they’re not abiding by the program. (So again I’m hammering home the point about rules being broken)&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Now I understand so Carl, I’m not. (New reflection?) Trying to look into it. Make sure that I can give you the best answer I can. It doesn’t. It may not be what you want to hear but I still haven’t made any determinations yet.&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;But I just trying. The reason I’m talking to ya&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;No, I appreciate that, but ta. Aa if I have any questions I will call you back to clarify where you’re coming from. But I don’t think there’s some then that I don’t understand.&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;That is why I’m glad to talk to ya, I’m having trouble talking to anyone but at least your listing to me a little bit right now.&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Oh ya no (Carl rudely interrupts)&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;I realize you work for the Forest Service and your going to have to lean a little in their direction? That would be my guess, is that right?&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Well no, I’m a mean, I I I’m hear to make sure that I can give the best advice I can to the folks that work here and a, you know, who I work for and the question becomes to make sure that Iii you know, what done is aaa I you know can said no we happen and we make thee employee the igan. It would be nice to come up with some then that aa might be an alternative or something that would work for you as well as for us. I, that’s obviously that’s the ideal thing as to you obviously still interested in the working. And having some training. And&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Definitely, definitely&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Well the idea is to aa, to see weather or not aa, maybe a problem that a particular job we have for that Discovery Center, maybe your not the right fit for that but maybe theirs something else you can do. I don’t know.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;I was definitely the right fit for that program as far as being able to handle it, but not being able to handle all those hours.&lt;br /&gt;&lt;br /&gt;Gill:&lt;br /&gt;Aa will I understood so essentially then, I understand that’s the concern for you is that a it would appear that a four hour day wasn’t was a, with your, with your physical problems that was the limit, right?&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Will I, I don’t know for sure. I wanted to start out with less hours and work my way up like it said in the letter. (Letter dated 12/14/05, page 2 of 4, second paragraph in section 2-A.) But they didn’t even give me the opportunity to start out at three hours or four hours a day, three or four days a week. They said, hay if you can’t do this you’re gone. They didn’t say I was fired. And I didn’t say I quit. I want to make that point very clear. I did not say that I quit.&lt;br /&gt;&lt;br /&gt;Even though they wanted me too. And they in return didn’t actually say hay you’re fired. But what they did say is sign this Exit Form. And if. Did you get a chance to look at that form so see if it is legitimate or may there been any forgery involved with that?&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;I, I don’t, I haven’t seen anything that indicates theirs forgery but I haven’t. Again like I said I haven’t of, I’ll look into this hole thing and then get back to you and make sure that you a, know and keep sending everything.&lt;br /&gt;&lt;br /&gt;I I understand that you’re, you’re adamant that you never told them you quit. And a, a that your, that’s where your coming from. I mean. Your essentially telling me, right now is what you like to see we can talk can we can with them and work in the Discovery Center.&lt;br /&gt;&lt;br /&gt;(As I type this and listen to the tape recording Gil seems to be eager to get off this subject of forgery?)&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Well if not, maybe some other place. (Gil interrupts and I respectfully back off)&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Well that’s what were goen have to tryda that what I’m gona have to tryda see what why their you know, maybe theirs a solution I don’t know yet.&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Well one other thing too why’ll I got-ya here a, you cold talk to Denis Tomas and see if he’s got any, those allegations I go against him. I mean if there’s kind of like a mind set in there of a, like I said of corruption or cronyism. Orrrrr (Sounds like a bloodcurdling growl,) just incompetence. I mean that, that seems to be a, almost the way that place is operated. I mean you look at it, their must be seven supervisors and only one full time employer (meant employee, slight chuckle) which in Anna. It’s, it’s really a bad setup. I know you haven’t been there but.&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Ok (Gil seems satisfied that he got Carl off the forgery and Exit Form subject?)&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Their whole atmosphere is kind of lousy to say the least.&lt;br /&gt;(Carl seems to be unable to stop babbling)&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Oh ya, but I think aa. On the one hand I think some of the things you said and some of the things they said you where their, your performance aa on the job and kind of getten with the people there think you did ok.&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;That was excellent. Got along real good except I didn’t know they where stabbing me in the back. Why did they want to get rid of me so quick? It was like there was no negotiating at all. That is why I think Denis Thomas is evolved with this a little bit.&lt;br /&gt;&lt;br /&gt;And that Erve and he’s a, I forgot what his last name is (Nichols is the last name) he kind of works with the volunteers. He was the guy that was on my emailing list aa all the emails criticizing the people of Big Bear and the politicians and the so called community leaders. I was bad mouthing them on how hypocritical they where. They where saying oh we’re here to help the community. Where in fact I couldn’t get them to consider putting a sit-down bus stop in front of the Hospital. Which is ridiculous. A you know that was just one of my complaints. Erve was just one of the guys on my mailing list.&lt;br /&gt;&lt;br /&gt;And I complained a lot about the YMCA right next store to me here. And there was a guy that worked there for 30 years and his partner for 25 years. And they fired them both. And ya, I blew the whistle on them but I’m a quality whistle blower I’ll tell you that.&lt;br /&gt;&lt;br /&gt;We had a big meeting at the Sheriffs Department and this guy at the least was doing drugs and at the most molesting children at the YMCA. And I’ll go on the record for that one.&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Ya&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Well anyway as you can see I’m getting a little excided here; and I am an activist and a complainer and if you do me wrong I’m coming back at them. And I feel they definitely their at the Discovery Center sure did a job on me. As much as I like to get a job, I can’t see this poisoning here dissipating from the Discovery Center. But if you can find me a job some place else.&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Right&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Ya know, aa, and a little bit more understanding working with me regarding the hours and the type of work, I sure would appreciate that.&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;Al right, that’s what where trying to do. Try and come up with a solution to all this.&lt;br /&gt;&lt;br /&gt;Carl:&lt;br /&gt;Ok, and try and look into the atmosphere of that place if you can?&lt;br /&gt;&lt;br /&gt;Gil:&lt;br /&gt;OK, like I say we’ll get back to you. On the surface this matter seems rather simple, so why is the response from the Forest Service so slow?&lt;br /&gt;&lt;br /&gt;2. Is the Forest Service SCSEP less caring about Elder Abuse and more concerned with protecting themselves from a law suite by deliberately, with malicious intent, prolonging the decision making processes in order to have the time restrictions prevent a lawsuit? See enclosed letter from Attorney Winer to Carl G. Mueller, Dated: February 8, 2006&lt;br /&gt;&lt;br /&gt;The prolonging and delaying of Carl’s request is in itself an abuse. Doolittle&lt;/strong&gt;&lt;/span&gt; and &lt;strong&gt;&lt;span style="color:#ff0000;"&gt;Richard Pombo&lt;/span&gt;&lt;/strong&gt;, set up special organizations, one called “Headwaters Forest Task Force”. This Forest Task Force helped legally manipulated a FDIC investigation into handing out only a &lt;strong&gt;$200,000.00&lt;/strong&gt; administrative cost to Doolittle and Pombo’s crony Hurwitz.  Doolittle, Pombo and Hurwitz where all backed by Abramoff and Tom DeLay of Texas.&lt;br /&gt;&lt;br /&gt;The connection is that I claimed I got primarily fired because of my negative political writings on my weblog and emailing similar negative information to Hansberger and a SCSEP connected employee and volunteers, and about a100 others, many local politicians. Example is the City Manager Perry who announced his early retirement on 1/11/06 in the Grizzly newspaper.  &lt;strong&gt;My weblog was also illegally updated on 11/29/05 while I was at work.
